A signed purchase <br />agreement has been received from one property owner with an intended closing on April 30. <br />The relocation expenses are exceeding the anticipated budget by $42,000 on the six properties <br />authorized. Projecting this deficit for the remaining six properties and adding in the cost of <br />refinancing, it is estimated that this deficit will be $I00,000 more than the attached March 1999 <br />estimate. A portion of the overage can be offset with $56,000 that will not be expended for the <br />razing of the homes. Discussion also took place on the position the City might take in <br />negotiating with three property owners who have either purchased a replacement residence <br />valued less than the comparable housing value or who will be moving into rental housing. The <br />land acquisition consultant has recommended that the City offer a lump sum settlement <br />consisting of the appraised value, housing differential cost, and the cost of moving. The lump <br />sum offer would eliminate the City's need to pay any refi.nancing costs or any additional <br />consultant expenses, since the lump Sum payment would, bring closure to the City's <br />responsibi!::ies in these c::;es. The Committee agreed to this course conting:nt upon a final <br />review of the legal aspects by the City Attorney. <br /> <br />Council Aw <br /> <br />Motion to authorize the Public Works Committee to approve final lump sum offers in the cases <br />of the prepe:ties at 14918, 14860, and 14930 St. Francis Boulevar~ NW. <br /> <br />Case #2: Discuss Drainage Issue at Intersection of 164th Lane and C.S.A.tt. #5 <br /> <br />The Committee discussed whether the City has the ability to prevent a property owner from <br />pumping water onto another property flu'ough enforcement action. Staff was directed to research <br />this with the City Attorney. It was also agreed that the key to a solution in this particular <br />situation was the ability to ultimately drain the run-off to the DNR-protected wetland to the east. <br /> <br />Council Action: <br /> <br />Motion to ratify the Public Works Committee directive that staff contact the property owner(s) <br />south of 164th Lane to discuss a solution and necessary easements. <br /> <br />Case #3: Request of Access to C.1L #116 <br /> <br />This case concerns the request of Mrs. Darlene Milless for an access to the new segment of C.R. <br />//116 for which her father had dedicated 9.1 acres without compensation. The Committee <br />directed that a temporary access be granted and that the City provide fill, culvert, Class 5, and <br />turf restoration for an access across the six-foot ditch section at a cost of $3,500. The Committee <br />directed that this access not be counted as a permanent access. <br /> <br /> <br />
