Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br /> RESOLUTION #99-05- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A MUSIC FESTIVAL LICENSE <br /> <br /> WHEREAS, on April 14, 1999, the Diamonds Sports Bar 8/ Grill, Inc. (Applicant) <br />properly applied for a Music Festival License on the property legally described as follows: <br /> <br />Lot 1, Block 1, The Diamonds, Anoka County, Minnesota <br />(the "Site); and <br /> <br /> WHEREAS, the Applicant submitted all application materials in accordance with <br />Chapter 7 (Licensing and Permits), Section 7.07 (Music Festivals); and <br /> <br />WHEREAS, City Staffpresented the application to City Council on May 11, 1999. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />A Music Festival License is hereby issued to Diamonds Sports Bar and Grill, Inc. <br />(Licensee) at 7550 Hwy. #10 N.W. for August 14, 1999, from 2:00 p.m. to 9:30 p.m., <br />however no outdoor music or liquor sales shall be permitted after 9:00 p.m. and the <br />definition of outdoor shall include the facility patio. <br /> <br />Outdoor liquor sales shall conform to State liquor laws relative to perimeter fencing and <br />declaration within the insurance policy. <br /> <br />This License shall not be considered effective until the Licensee has provided the <br />following: <br /> <br />The Licensee herein agrees to reimburse all owners and occupants of property adjoining <br />the Site for any and all loss, injury or damages to such owners or occupants or to their <br />property caused by the Licensee, by the owner of the Site, or by any person attending or <br />participating in the Music Festival, which damage shall not have occurred had the <br />Music Festival not been held. A bond shall be provided in favor of the City and all <br />persons to whom the Licensee and/or owners of the Site may be liable. Said bond shall <br />be prepared by a corporate bonding company authorized to do business within the State <br />of Minnesota and shall be in the amount of not less than $50,000.00. <br /> <br />bo <br /> <br />A policy of public liability and property damage insurance, in a form satisfactory to the <br />City, in the amount of $250,000.00 for injury to any one person and $500,000.00 for <br />injury to more than one person, and in the amount of $50,000.00 for property damage. <br />Said insurance policy shall be in effect until August 14, 2000.
