this variance request because compliance with DNR's minimum of 150 feet would be maintained <br />on all 3 of the riparian lots. <br /> <br />The lots are proposed to receive public access from the extension of a cul-de-sac east off of <br />Andrie Street. The cul-de-sac length is approximately 1,000 feet and a variance to the 600 foot <br />maximum cul-de-sac length was also granted by the Board of Adjustment on May 4. The <br />variance was granted based on the fact that the subject area is basically a peninsula of <br />developable property not wide enough to accommodate a looped road system through the area. <br /> <br />Additionally, the preliminary plat proposes to name the street Itasca Point Road, which is a <br />deviation from the City's grid system and requires Council approval. <br /> <br />In accordance with the Northfork Park Dedication Agreement dated May 9, 1989, park <br />dedication for this portion of the P.U.D. has been previously satisfied with land dedication. <br /> <br />The Grading and Drainage Plan has been reviewed by the City Engineer and he has <br />recommended a modification consisting of an elongated sedimentation basin on the common <br />property lines of Lots 6 and 7. The developer is modifying the Plan accordingly. <br /> <br />A Tree Preservation and Planting Plan is also being prepared for the total site and on a lot by lot <br />basis. <br /> <br />The Planning Commission conducted the preliminary plat public hearing on April 6. No verbal <br />or written comments were submitted. The Commission tabled action on the preliminary plat <br />until May 4, after the Board of Adjustment takes action on the variance requests. All variances <br />were approved. <br /> <br />On May 25, the preliminary plat was presented to City Council. The Council tabled action and <br />requested additional information on the following issues: a) suitability of topography for septic <br />systems; b) how to avoid the open space outlot from going tax forfeit; c) adequacy of cul-de-sac <br />turning radius for large emergency vehicles; d) deviating from street grid pattern for road name. <br /> <br />North Fork, Inc. has engaged the services of environmental specialist, Jon Christensen, to <br />prepare a report on the ttasca Point septic systems as it relates to soils and topography. That <br />report is enclosed and reports no concerns with the proposed septic systems. <br /> <br />Staff talked with Scott Varner at the Anoka County Assessor's office and learned the following <br />information. There is a State statute that requires the assessors to add the value of common <br />space into the assessed valuation of each of the homesteads and not place a separate value on <br />open space that would result in a separate payable tax statement to the homeowners association. <br />To simplify this process, Anoka County prefers that the open space be deeded to the <br />homeowners association and that the declaration of common space be amended to establish that <br />the new lot owners have rights to all previously dedicated open space and that all existing lot <br />owners have rights to the newly platted open space. This procedure has been followed by North <br />Fork in all previous phases. The County Assessor's office also states that if a value was placed <br />on common space, it would be minimal. If Council is not satisfied with this procedure, North <br />Fork Homeowners Association has provided Staff with a commitment to combine the open space <br />outlot with the adjacent park. <br /> <br /> <br />
