WHEREAS, the Plat consists of two (2) lots totaling approximately .8 acres; <br /> <br /> WHEREAS, approval of the Final Plat is given pursuant to the City's Subdivision Code <br />Section 9.50.05 (Subd. 2) entitled "Division or Consolidation of unplatted Lots". <br /> <br /> WHEREAS, no expenditure of CITY funds will be made until City Code escrow <br />requirements have been fulfilled by the DEVELOPER. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />IMPROVEMENTS <br /> <br />Access to Lots. Lots I and 2 shall have public access from 149th Lane N.W., an existing <br />improved public street. Cross easements for use of the common driveway between Lots 1 <br />and 2 shall be provided and recorded at the office of the Anoka County Recorder. <br /> <br />Drainage and Utility Easements. ;'The standard drainage and utility easements around <br />the perimeter of each of the two lots, together with a utility easement across Lot 1 for <br />overhead power lines shall be dedicated on the Final Plat. <br /> <br />II. <br />GENERAL <br /> <br />Park Dedication. The Plat is in the Prairie Park District. The Plat does not create any <br />new lots and no park dedication is due to the CITY. <br /> <br />Park Trail Development Fee.. The Plat does not create any new lots and no park trail <br />development fee is due to the CITY. <br /> <br />Stormwater Management Fee. The Plat does not create any new lots and no stormwater <br />management fee is due to the CITY. <br /> <br />Reimbursement to City. The DEVELOPER agrees to reimburse the CITY for all costs <br />incurred by the CITY in defense or enforcement of this Agreement, or any portion <br />thereof, including court costs and reasonable engineering and attorney's fees. Said <br />expenses shall be paid within fifteen (15) days of billing by the CITY and failure to pay <br />the CITY'S expenses within the fifteen (15) day billing period will permit the CITY to <br />· draw upon any of the escrows required by this Agreement for payment. <br /> <br />Plat Expense Reimbursement. The DEVELOPER agrees that he/she will pay to the <br />CITY out of any of the escrows required herein, ail CITY expenses incurred in approval <br />of the Plat, including, but not limited to administration expenses, engineering and legal <br />fees.
