Attorney Goodrich stated that the name could be changed at final plat <br />approval. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendricksen, Zimmerman and <br />Anderson. <br /> <br />Case #6 <br /> <br />Request for Approval of Metes and Bounds Subdivision; Case of Ronald <br />Danner <br /> <br />Zoning Administrator Frolik stated that Ron Danner resides at 17400 Erkium Street Northwest. <br />His property is 27 acres in size and he is requesting approval of a metes and bounds subdivision <br />to separated his homestead and four acres of land from the remainder of his property. <br /> <br />Zoning Administrator Frolik explained that Mr. Danner desires to sell his home with four acres <br />of land and retain the remaining 23 acres for possible future development. The homestead parcel <br />is subject to the regulations of the Scenic River Overlay District, for which the minimum lot size <br />is four acres for riparian lots. The property is also in the Rural Transition area for which there is <br />a four units in 40 acre density restriction. The subdivision proposed complies with the four in <br />forty density restriction and the four acre minimum lot size. City Code promotes division of <br />property by platting, but also allow for metes and bounds subdivisions where there is a hardship. <br />Mr. Danner's property does not have direct access to a public road and access is currently and <br />would continue to be provided to the home by a private easement across the 40 acre parcel <br />between Mr. Danner's property and Erkium Street to the north. No matter what means is used to <br />split the property, Mr. Danner was informed that no other building permits would be issued on <br />the subject property unless a public road was constructed to City standards into the property. <br /> <br />Zoning Administrator Frolik explained that on May 25, 1999, the City Council reviewed the <br />request for a metes and bounds subdivision and tabled any action for additional information <br />regarding: a) the private access easement; b) how the division of property with no public access <br />relates to the procedure used for Pettersen Estates; c) what other subdivisions have been allowed <br />without public access; d) a future development plan coordinated with the property to the north <br />and the northwest. In addition, Staff sought input from Public Works Director/Fire ChiefKapler <br />regarding emergency response concerns on a 2,200 foot private driveway. <br /> <br />Zoning Administrator Frolik noted that City Attorney Goodrich has reviewed the private access <br />easement across the 40 acre parcel between Mr. Danner's property and Erkium Street to the <br />north. The easement is non-exclusive, which means that is runs with the land. If the lot splits <br />occurs, Mr. Danner would have to provide the buyer of his home with an additional access <br />easement to cross the 23 acres he is proposing to retain. <br /> <br />City Council/June 8, 1999 <br /> Page 9 of 9 <br /> <br />/6-7 <br /> <br /> <br />
