Apple Valley-Special promotions in commercial zoning districts such as carnivals at <br />hopping centers are permitted as accessory uses when approved by the zoning <br />administrator subject to six conditions. The applicable conditions to carnivals include <br />approval by the owner of the property and limiting the use to ten days, <br />Brooklyn Center-The City requires an administrative land use permit for carnivals. The <br />City's ordinance limits tents, stands or other temporary structures for a period not <br />exceeding ten days. Certificates of insurance are required. Most of the regulations are <br />handled administratively once the permit is issued. If Council wishes, Staff could request <br />a copy of the last carnival permit issued to review administrative regulations imposed on <br />the carnival. If a permit is issued to an organization and the carnival site is not cleaned <br />up or there are police related problems, chances are they will not receive a permit again to <br />operate. <br />Eagan- Regulates carnivals through zoning for temporary outdoor events. Performance <br />standards are required including the provision of adequate off street parking, signage <br />regulations, building permit requirements for tents in excess of 200 square feet and <br />canopies in excess of 400 square feet, permission from the land owner, and a limit on <br />hours of operation. <br /> <br />Elk River- City does not regulate carnivals. Carnivals are handled through Sherbume <br />County <br />Oak Grove- Oak Grove responded to the survey that the City does not have any <br />ordinance regulating carnivals. Oak Grove Acorn Days, which is a non-profit <br />corporation, is in charge of thc city celebration and invites a carnival for that weekend. <br /> <br />Council inquired about regulating carnival operators to 18 years or older. Minnesota Rules <br />5200.0910 (attached) prohibits minors under 18 years old from operating, erection or dismantling <br />of fides or machinery in an amusement park, street carnival or traveling show, or in the loading <br />or unloading of passengers on fides. <br /> <br />Committee Action: <br />Following discussion, provide direction to Staffto prepare an Ordinance regulating carnivals. <br /> <br />Council Action: <br /> <br />Based on Committee discussion. <br /> <br />Reviewed By: <br />City Administrator <br />Zoning Administrator <br /> <br />Copies also distributed to: <br /> <br />i <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br /> <br />
