ORDINANCE #99- CITY OF RAMSEY ANOKA COUNTY STATE O1* MINNESOTA AN ORDINANCE REPEALING ORDINANCE #98-05 TO VACATE CERTAIN ROAD RIGHT-OF-WAY IN THE CITY OF RAMSEY, ANOKA COUNTY, MINNESOTA. The City of Ramsey Ordains: SECTION 1. AUTHORITY This ordinance is adopted pursuant to and under the authority of the Home Rule Charter of the City of Ramsey, Section 12.06 and Minnesota Statutes 412.851. SECTION 2. REPEAL Whereas, Ordinance #98-05 was adopted on April 14, I998 for the purpose of vacating a portion of the McKinley Street road right-of-way in Business Park 95 Second Addition; and Whereas, Ordinance #98-05 contained a typographical error in the legal description of that portion of road right-of-way to be vacated as being in Business Park 95 Fourth Addition; and Whereas, Ordinance #98-05 was recorded at Anoka County on April 16, 1998 as Document No. 1335047.0 against Business Park 95 Fourth Addition; and Whereas, Ordinance #99-11 was adopted by the Ramsey City Council on August 24, 1999 with the correct legal description for vacating a portion of the McKinley Street right-of-way in Business Park 95 Second Addition; and Whereas, Ordinance #99-11 was forwarded to Anoka County for recording against the plat of Business Park 95 Second Addition. Now, therefore the City Council of the City of Ramsey hereby repeals Ordinance #98-05 and directs City Staff to forward the repealing of 98-05 to the County for recording against the plat of Business Park 95 Fourth Addition. SECTION 3. EFFECTIVE DATE This Ordinance becomes effective thirty (30) days after its publication subject to the City Charter Section 5.07.
