10. <br /> <br />11. <br /> <br />12. <br /> <br />That the Applicant has stated that the Subject Property contains severe slopes in <br />topography that result basically in a penninsula not wide enough to accommodate two <br />roads. <br /> <br />That average lot width of the 7 lots at the road frontage or building setback line is <br />approximately 200 feet, but on an individual basis, Lot 5 is approximately 30 feet <br />deficient of the 200 foot width requiremem. <br /> <br />That the Applicant is proposing to locate building pads on riparian Lots 4 5, and 6 that <br />do not meet the City's 200 foot structure setback requirement from ordinary high water <br />mark, but do maintain compliance with the recommended 150 foot setback contained in <br />Minnesota Rules. <br /> <br />That the Applicant has stated that locating the structures on Lots 4, 5 and 6 in <br />accordance with Minnesota Rules versus Ramsey City Code will provide the opportunity <br />to save many mature trees and minimum disruption of existing grades. <br /> <br />That the special conditions causing the hardship do not result from the actions of the <br />Applicant. <br /> <br />That if granted, the variance will/will not grant the Applicant any special privilege that is <br />denied to other owners of lands in the same district. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br /> and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br />and the following abstained: <br />and the following were absent: <br /> <br />whereupon said resolution was declared duly adopted by the Ramsey Board of Adjustment this <br />the day of May, 1999. <br /> <br />ATTEST: <br /> <br />Chairperson <br /> <br />City Administrator <br /> <br /> <br />
