10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />That the Applicant has stated that preserving a 20 foot wide corridor along the front property <br />line (in addition to the requirement for a 20 foot wide required landscape area adjacent to <br />public roads) for a possible future service road has caused an undue hardship which results in <br />the building encroaching on the rear yard setback requirement. <br /> <br />That there are/are not unique circumstances applying to the Subject Property that do not <br />generally apply to other properties in the B-3 Highway Business district. <br /> <br />That the special conditions causing the undue hardship do/do not result from the actions of <br />the Applicant. <br /> <br />That if granted, the variance will/will not grant the Applicant any special privilege that is <br />denied to other o'amers of lands, structures or buildings in the same district. <br /> <br />That if granted, the variance wilt/will not be materially detrimental to the purposes of the <br />Ramsey Zoning Chapter or other property in the B-3 Highway Business District. <br /> <br />That if granted, the variance will/will not substantially increase the congestion of public <br />streets, or increase the danger of fire, or endanger the public safety, or substantially impair <br />property values within the neighborhood. <br /> <br />That if the variance is denied, the Applicant will/will not be able to put the property to <br />reasonable use. <br /> <br />The motion for the adoption of the foregoing resolution was' duly seconded by Board Member <br /> and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br />and the following abstained: <br />and the following were absent: " <br /> <br />whereupon said resolution was declared duly adopted by the Ramsey Board of Adjustment this <br />the __ day of ., 1999. <br /> <br /> Chairperson <br /> <br />ATTEST: <br /> <br />C:..T Administrator <br /> <br /> <br />
