8. That there are uniquie circumstances applying to the Subject Property that do not generally apply <br />to other properties in the district; namely, that the street frontage at County Road #63 meets the <br />minimum tot width requirement but access to the proposed building site is obstructed by a County <br />ditch and the fact that City Code discourages access onto a County road when an alternative access <br />is possible. <br /> <br />9. That the unique circumstances do/do not result from the actions of the Applicant. <br /> <br />10. That such variance is/is not necessary for the preservation of a substantial property right similar <br />to that possessed by other properties in the R-1 Rural Residential District, namely the ability to <br />have at least one dwelling on a 20 acre parcel. <br /> <br />11. That if granted, the variance will/will not grant the Applicant any special privilege that is <br />den/ed to other owners of lands, structures or buildings in the same district. <br /> <br />12. That if granted, the variance will/will not be materially detrimental to the purposes of the <br />Ramsey Zoning Chapter or other property in the R-1 Rural Residential District because the <br />Applicant is proposing to locate the home on the Subject Property so as not to obstruct extension of <br />public streets into the Subject Property when it is developed to its ultimate density. <br /> <br />13. That if granted, the variance will/will not substantially increase the congestion of public streets, <br />or increase the danger of fire, or endanger the public safety, or substantially impair property values <br />within the neighborhood. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br /> and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br />and the following were absent: <br /> <br />whereupon said resolution was declared duly adopted by the Ramsey Board of Adjustment this the <br /> day of ,1999. <br /> <br />ATTEST: <br /> <br />Chairperson <br /> <br />City Administrator <br /> <br /> <br />
