Case #8: <br /> <br />Authorization to Request Extension for Submittal of Comprehensive <br />Plan <br /> <br />Community Development Director Sherman stated that State regulations call for <br />submittal of the Comprehensive Plan to the Metropolitan Council by December 31, 1998. <br />There are provisions to request an extension to the deadline. In order to request an <br />extension, the Council must adopt a resolution and submit the resolution along with a <br />questionnaire to be completed. She added that the City must identify a target date for <br />submittal of the plan. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beahen to <br />direct staff to prepare a resolution requesting an extension for the deadline to submit the <br />Comprehensive Plan to the Metropolitan Council and completion of the related <br />questionnaire. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beahen, <br />Beyer and Zimmerman. Voting No: None. <br /> <br />Case #9: <br /> <br />Consider Draft Ordinance to Change Name of Fire Board to Public <br />Safety Board <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to <br />introduce the revised ordinance changing the name and function of the Fire Board to the <br />Public Safety Board. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beyer, <br />Beahen and Zimmerman. Voting No: None. <br /> <br />Case #10: Tobacco Ordinance Violation Administrative Hearings <br /> <br />City Attorney Goodrich reported that two of the City's tobacco licensees whose <br />employees illegally sold tobacco to minors on April 30, 1998, are requesting <br />administrative heatings with regard to the licensees civil liability. The ordinance allows <br />for either the City Council to act as the heating officer, or the use ora State of Minnesota <br />heating officer. The cost of the heating officer is $93 per hour. He recommended the <br />City hire a hearing officer and estimated that both hearings could be completed at a cost <br />of approximately $1,000. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to <br />direct the City Attorney to schedule the required administrative hearing and to authorize <br />the use of a heating officer from the Minnesota Office of Administrative Heatings to be <br />paid at the rate of $93 per hour. <br /> <br />Motion carried.
