Case #11: <br /> <br />Consider Eminent Domain Authority to Utilize a Land Parcel for <br />Wetland Mitigation <br /> <br />Director of Public Works Kapler explained that a tract of land which includes ownership <br />by Connexus Energy, the City of Ramsey and Waste Management, Inc., exists in the <br />general area northwest of the intersection of C.R. #116 and Sunwood Drive NW. A <br />development plan has been prepared which combines these three properties in order to <br />accommodate a feasible economic development of this land which is bounded by <br />wetland, and the above named roadways. Mr. Kapler presented a sketch of the area. He <br />pointed out that the parcel owned by Waste Management Inc. is only 0.9 acres in size and <br />too small to be developed by itself. It would also require an access directly out on C.R. <br />#116 which is undesirable. The plan for the development of this area will require <br />wetland filling. Approval has been secured from the WMO for this filling, however, <br />wetland mitigation is required. He asked Council to consider eminent domain to <br />purchase the property. <br /> <br />City Administrator Norman commented on the major merger for Waste Management and <br />that now this sale may not be allowable. However, that does not prohibit the City from <br />condemning the land. <br /> <br />Motion by Councilmember Beahen and seconded by Councilmember Beyer to adopt <br />Resolution #98-11-287 utilizing eminent domain proceedings for the acquisition of parcel <br />part of PIN 27-32-25-13-000t. <br /> <br />Further discussion: Councilmember Haas Steffen inquired why the City would be <br />financing this with TIF. Mr. Norman replied that this is TIF District #6 and we have a <br />limited area to spend the money in and this would be a compliant use. <br /> <br />Motion carded. Voting Yes: Mayor Gamec, Councilmembers Beahen, Beyer, Haas <br />Steffen and Zimmerman. Voting No: None. <br /> <br />Case #12: Report from Road and Bridge Committee <br /> <br />1) Update on T.H. #47 STP Project <br /> <br />Director of Public Works presented an update on the T.H. #47 STP Project. There are <br />still issues with MnDOT - traff~c counts for warranting signals, etc. MnDOT is not in <br />support of a traffic light on #47 and 142nd Avenue. Staff will continue to work on this <br />and report back. <br /> <br />2) Request for a Stop Sign at 144th Lane and Tungsten Way <br /> <br />The Police Department will complete a speed study in the area of 144th and Tungsten <br />within the next month or so. A new traffic count will also be completed in the spring. <br /> <br />3) Report on Proposed C.R. #116 Improvement Project <br /> <br />City Council/November 24, 1998 <br /> Page 12 of 20 <br /> <br /> <br />
