CASE # <br /> <br />REVIEW URBAN SIDEWALK AND TRAIL ORDINANCE <br /> By: Mark Boos~ Parks/Utilities Supervisor <br /> <br />Background: <br /> <br />At the December 20, 1999 Planning Commission meeting, the subject of road right-of-way sidewalk or <br />trail siting within urban residential subdivisions was discussed. There was general consensus that <br />specifics with regard to when they were necessary and who constructs them is in order. <br /> <br />At the January 13, 2000 Park Commission meeting, the Commission approved a draft resolution that <br />addressed sidewalk/trail siting and construction responsibility. It was acknowledged that a resolution <br />may be adequate to define this policy until the terms could be incorporated into City Code. Staff is <br />recommending, however, that an ordinance may be more effective because the review and changes to <br />the subdivision chapter of City Code, based on the amended Comprehensive Plan, may take many <br />months to complete. Further, an ordinance puts prospective developers on notice of their obligation <br />and is less subjective than a resolution. <br /> <br />Observations: <br />The purpose of this case is for the Planning Commission to provide comment of the draft ordinance. <br />An excerpt of City Code, as it is proposed to be amended, is enclosed. The amendment is shown in <br />bold print. A copy of the proposed ordinance to implement the amendment is also enclosed. The time <br />line is proposed as follows: <br /> <br />February 2000 Planning Commission Meeting <br /> Commission recommends any amendments to draft ordinance. <br />February 10, 2000 Regular Park Commission Meeting <br /> Commission hosts informational meeting to hear comments from developers and others on the <br /> proposed ordinance impacts. <br />March 6, 2000 Regular Planning Commission Meeting <br /> Commission holds public hearing. <br />March 14, 2000 City Council Meeting <br /> Ordinance introduced. <br />March 28, 2000 City Council Meeting <br /> Ordinance adoption.. <br /> <br />Commission Action: <br /> <br />Motion to recommend that City Council adopt the proposed ordinance for urban sidewalks and trails. <br /> <br />Reviewed by: <br />Parks/Utilities Supervisor <br />Community Development Director <br /> <br />Copies also distributed to: <br />City Council <br />Park & Recreation Commission <br />City Engineer <br />Director of Public Works <br />Community Development Assistant <br />Community Development Secretary <br /> <br />PC: 02/01/00 <br /> <br /> <br />
