(Added, Ord. No. 92~26, Sec 3) <br /> <br />Ord. No. 86-25, Sec. 1) <br /> <br />610:15. Constructior~and~eD ah'_pf l:'ublic Sidewalks. <br /> <br />Subd. 1. P_ermils~equired. No sidewalk shall be constructed or repaired on any street, avenue or <br />olher public property in th/s municipality without first having obtained a permit from the Council and <br />having paid the required permit fee in the mount set b'y the Council from time to time in Chapter V <br />of this Code~ Application for such permit shall be made on forms to be approved by the Council and <br />shall sufficiently describe the contemplated improvement, the contemplated date of beginning work <br />and the Iength of time for completion ofsame~ NO permit shall be required for any such impro~,ement <br />ordered to be installed or made by the mun/cipality. ' <br /> <br />Subd. 2. SDecifications_and_~egulations fo_r_Constru~on or Repair. All sidewalks constructed or <br />repaired upon any street, avenue or other public property in this municipality, shall be constructed <br />according to plans and specifications prepared by the municipality and set forth in the permit issued <br />for such improvement or repair order. Expenses incurred by the municipality in establishing grades, <br />assisting in deterrrfin/ng location, and preparing basic engineering plans and specifications, if any, may <br />be paid in full or in part by the municipality or charged against the applicant in which event said <br />expe .n..ses shall be payable by him in full as a condition precedent to issuance of the permit. <br /> <br />Subd. 3. D_u _ty' of_Owner. The owner of any property w/thh the mm'ficipality abutting a public <br />sidewalk shall keep the sidewalk in proper repair and safe for pedestrians. Repairs shall be made in <br />accordance with the specifications set forth by the Council in the permit or repair order. <br /> <br />SubcL 4. D_.RSLq~.~. It shall be the duty of'the Clerk or other designated official '~o make such <br />inspections as are necessary to determ/ne that public sidewalks within this mmaicipality"are kept in <br />repair and safe for pedestrians. If the Clerk finds that an7 sidewalk abutting on private property, is <br />unsafe and in need ofrepai:rs, the Clerk shall cause a notice to be served by registered or certified mail <br />or by personal service, upon the record owner ofthe properly and the occupant, if the owner does not <br />reside within the municipality or cannot be found therein, ordering such owner to have the sidewalk <br />repaired and made safe within thirty (30) days and stating that if the owner fails to do so, t,he Clerk or <br />other official w/ll do so on behalf of this municipality, that the ~pense thereof must belpaid by the <br />owner, and that if unpaid it will be made a special assessment against the property concehaed. <br /> <br /> <br />
