was recommended that Burger King maintain compliance with the current 25 foot height <br />restriction. On June 8, 1999, the request and the Planning Commission's recommendations were <br />presented to City Council. At that time, the applicant informed the Council that the Burger King <br />franchise has .just released their new sign design. It is a 113 square foot circular sign. The <br />applicant then stated that their request was being amended to the 113 square foot logo sign with <br />45 square foot reader board that would comply with the 25-foot height restriction. Ms. Frolik <br />stated that Chairperson Leo Anderson was at the City Council meeting and at his request, the <br />City Council sent the amended application back to the Planning Commission for their review and <br />recommendation. On July 6, 1999, the applicants presented the new Burger King logo and sign <br />plan to the Planning Commission. The sign design has changed from square to round and the <br />size choices are 64 square feet or 113 square feet. The sign is not proposed to exceed the 25 foot <br />height restriction. <br /> <br />Councilmember Hendriksen stated that it appeared that a lot of the other businesses complied <br />with the 100 square foot requirement and thought that Burger King should do the same. <br /> <br />Greg Klone, Dolphin Real Estate, stated that the smaller sign is approximately 60 square feet and <br />he feels that they need a larger sign because of alt the clutter on Highway #10. <br /> <br />Councilmember Zimmerman stated that maybe the Plarming Commission should review the <br />ordinance and determine if 100 square feet is too small. <br /> <br />Mayor Gamec stated that he has received a lot of requests for placing a kiosk sign on Highway <br />#10 pointing to the business located off Highway #I0. <br /> <br />Motion by Councilmember Zimmerman and seconded by Mayor Gamec to adopt Resolution <br />#99-07-131 adopting Findings of Fact # 0501 relating to Dolphin's request for a conditional use <br />permit for a sign size overage. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, and ,~mderson. <br />Voting No: Councilmember Hendriksen. <br /> <br />Motion by Councilmember Zimmerman and seconded by Mayor Gamec to approve Dolphin's <br />request, based on the findings of fact #0501, and granting a sign size overage of 58 square feet <br />and adopt Resolution #99-07-132 declaring terms of same. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, and Anderson. <br />Voting No: Councilmember Hendriksen. <br /> <br />Councilmember Hendriksen stated that he agrees that there are a lot of "trash" signs placed on <br />other signs along Highway #10 and that he doesn't think it is worth putting companies through <br />this process when they are allowed cardboard signs being attached to business signs. <br /> <br />City Council/July 13, 1999 <br /> Page 14 of 18 <br /> <br /> <br />
