NOW, THEREFORE, it is mutually stipulated and agreed: <br /> <br />I. PURPOSE <br /> <br /> The County and the City have joined together for the purpose of constructing the roadway, <br />drainage, and sidewalk, as well as other utilities, on a new alignment to be known as Industry <br />Boulevard as described in the Exhibit which is attached hereto and incorporated as part of this <br />Agreement. <br /> <br />II. METHOD <br /> <br /> The County shall provide all engineering services and shall cause the construction of Anoka <br />County Project 95-05-116 in conformance with said plans and specifications which shall be reviewed <br />and approved by the City Engineer prior to calling for bids. The calling for all bids and the <br />acceptance of all bid proposals shall be done by the County. <br /> <br /> The County shall cause the construction of this project and the City shall reimburse the <br />County for its share of the costs. <br /> <br />The County shall acquire all permits required for the construction of this project. <br /> <br /> The City shall acquire 120 feet of fight-of-way plus all temporary easements necessary for <br />the construction of Industry Boulevard on an alignment acceptable to the County. The City shall <br />convey the right-of-way to the County. <br /> <br /> The City shall limit access to the proposed Industry Boulevard between County Road 56 <br />(Ramsey Boulevard) and County Road 83 (Armstrong Boulevard) to six (6) access locations. For <br />the purpose of this provision, a cross street will constitute two (2) access locations, one on each side <br />of Industry Boulevard. <br /> <br /> The City shall indemnify and hold harmless (including attorney fees) the County from any <br />and all damages that the County may incur as a result of the limiting of access to Industry Boulevard <br />as provided herein. <br /> <br />-2- <br /> <br /> <br />
