PW CASE <br /> <br />REQUEST FOR ACCESS TO C.R. #116 <br />By: Steve Jankowski, City Engineer <br /> <br />Background: <br /> <br />Attached is a letter sent to City Attorney Goodrich last fall, on behalf of Darlene Millis, <br />requesting clarification on the issue of obtaining access to C.R. #116, between C.R. #56 <br />and C.R. #83. You will also recall that when this roadway was constructed last fall, the <br />City entered into a joint powers agreement with Anoka County to limit the number of <br />access points to six along this segment of County Road. To answer Mr. Bannigan's <br />inquiry directly, Mrs. Millis needs to make access request to Anoka County since it is a <br />County roadway. The County will not issue the access permit until the City indicates to <br />the County that it agrees to release one of its six access points for this request. <br /> <br />Mrs. Millis' father, the late Mr. Peltzer, dedicated 9.1 acres of land for the right-of-way, <br />which accommodates C.R. #116, apparently without compensation. Certainly she <br />deserves some consideration because of this. It has been suggested that she be granted a <br />temporary access until such time that Section 28 planning can be completed and perhaps <br />a frontage road can be extended to replace the direct access. Mrs. Millis would like the <br />access as soon as possible. To provide such an access, a driveway would need to be <br />constructed over the six-foot ditch section. The cost of providing the fill, culvert pipe <br />with endwall, and seeding and stabilization is estimated to be approximately $3,500. <br /> <br />Discussion: <br /> <br />Certainly on a temporary basis, this seems to be a reasonable response to Mrs. Millis' <br />request in view of the donations made by her father. Staff's chief concerns are how <br />temporary this driveway will be. Certainly a careful legal document should be drafted to <br />ensure this does not become a permanent access point. Secondly, a future service road to <br />replace this access may be necessary to service this property alone, which could place a <br />much different cost on this solution. <br /> <br />Committee Action: <br /> <br />Based upon discussion. <br /> <br />Reviewed by: <br /> <br />City Engineer <br />Director of Public Works <br />City Administrator <br /> <br />PW: 04/20/99 <br /> <br /> <br />
