CASE

PROPOSED ORDINANCE TO AMEND CITY CODE CHAPTER 8 (BUILDING AND
HOUSING) AND CHAPTER 9 (ZONING AND SUBDIVISION OF LAND)
By: Zoning Administrator Sylvia Frolik

Background:

Section 8.01 of Chapter 8 in the City Code calls out which version of the State Building Code is
being administered and enforced by a number and/or date. Each time the State adopts a new
version, our Code has to be amended to reference the correct version. Building Official Glyn
Huff has requested that Staff initiate an ordinance to amend the Building and Housing section of
City Code. The amendment proposes to reference the version of the Building Code to be
enforced as simply the State's "current" rather than by a specific number or date. This way our
City Code is in perpetual compliance with the State's Building Code, and the need to amend City
Code for each new State version of the Building Code is eliminated.

In addition, there is language in Section 8.01 that requires persons to complete the exteriors of
buildings within one year of construction commencement. The Building Official feels that this
language is not pertinent to the Building Code and is more appropriately located in Chapter 9,
Zoning and Subdivision of Land, under General Requirements.

Observations:

Enclosed for your information is a copy Section 8.01 with strikethroughs to show text to be
eliminated and underlines to show text to be added. Text to be relocated to Chapter 9 is also
noted. Amendments to Chapter 8 do not require a public hearing, but amendments to Chapter 9
do. Because part of the text is to be relocated to Chapter 9, the proposed ordinance is subject to a
public hearing.

Also enclosed for review is the proposed ordinance.

Recommendation:

City Staff recommends that the Planning Commission forward the proposed ordinance to City
Council for adoption.

Commission Action:

Motion by and seconded by to recommend that City
Council adopt an ordinance to amend Section 8.01 of the Ramsey City Code to reference the
State's 'current' building code.

Review Checklist:
Building Official
Community Development Director
Community Development Assistant
City Attorney

PC: 04/06/99
