We offer the <br />following comments: <br /> <br /> :: <br />1. General: The proposed plat is a minor subdivision that proposes to subdivide a 27 acre <br /> par.eel into one lot and one outlot.. The minor subdivision will separ~.te the existing <br /> homestead and 4 acres of land from the remaining 23 acres that is proposed to be platted as <br /> an ouflot for future subdivision. <br /> <br />Zonine: The property is zoned R-1 Rural Residential and is located in the Rural Transition <br />Area. The property is also located in the Scenic River Overlay District. Under the Rural <br />Transition Area, the property 'is restricted to a density of 4 units in 40 acres. 'The minor <br />subdivision does not create any new lots and is therefore in compliance with the 4 in 40 <br />restriction. <br /> <br />'.Lot Sizes: Under the Scenic River regulations, the minimum lot size for riparian lots on the <br />Rum River in this area is 4 acres. The hamestead is proposed to platted with 4 acres of land <br />and is in compliance with Scenic River regulations. <br /> <br />e <br /> <br />Lot Dimensions: Under the Scenic River Regulations, riparian lots must be 300 feet wide at <br />the building setback line and at the ordinary high water level. It appears that Lot 1 meets <br />these requirements. <br /> <br />4 <br /> <br />Structure Setbacks: The required structure setback from ordinary high water level is 150 <br />feet. The existing homestead on the property does not meet this requirement and it is not <br />possible for the subdivision plan to correct this situation. The home location is considered <br />lawful non-eon.forming. The home may remain in its current location at is current size, but it <br />cannot be enlarged without a variance. In addition, if the home is ever destroyed to more <br />than 50% of its value, it cannot be reconstructed in the same location without a variance. <br /> <br /> <br />
