PROPOSED ORDINANCE AMENDING PERMITTED USES
IN ALL ZONING DISTRICTS
By: Zoning Administrator Sylvia Frolik

CASE #

Background:

As you know, the City Council has selected a site for a second fire station. The property
is zoned R- 1 Rural Residential and public buildings or uses are not a permitted use in this
zone.

Observations:

City Code defines "Public Uses" as uses owned or operated by municipal, school district,
county, state or other governmental units. Currently, public uses are only allowed in the
Multiple Residential, B-3 Business, and Business Warehouse districts. In addition, this
type of use is not referenced in these '3 districts as the Definitions section identifies it
(Public Use). Rather, it is listed under Permitted Uses as either "public buildings" or
"governmental and public utility buildings and structures".

Recommendation:

City Staff recommends that for consistency, the references to "public buildings" and
"governmental and public utility buildings and structures" be changed to "public uses" in
those districts already allowing public uses; and that the other districts be amended to
include "public uses" as permitted uses.
