Councilmember Anderson inquired if Minnesota State Statue 444 is workable. <br /> <br />City Attorney Goodrich replied that the Statue is very workable, and to move forward the <br />Council would need to establish a district, direct Staff to schedule a public hearing, and adopt an <br />ordinance and feasibility study. <br /> <br />Councilmember Hendriksen replied that the boundaries were proposed during the previous <br />Council meeting including the area from Highway #10 to the railroad tracks and from Sunfish <br />Lake Boulevard to the City of Ramsey border. <br /> <br />Councilmember Anderson inquired if the railroad had been contacted. <br /> <br />Lowell Zitzloff, stated that he was under the impression that the City would be contacting the <br />railroad company. If he is required to take care of the drainage problem himself then he would <br />be happy to contact the railroad. He requested that he be allowed to move ahead with taking care <br />of his own drainage problem and then if the City wants to place an oversized pipe under the <br />railroad tracks in the future then he would be willing to connect to it. <br /> <br />Councilmember Hendriksen replied that one of the things that he has learned by being a <br />Councilmember is that if they allow something to a happen without solving the larger problem, it <br />always has a way of coming back to the City. He explained that there are adjoining parcels that <br />drain onto his property and his perception is that he would correct his problems and then the City <br />would have a drainage problem on adjacent properties. <br /> <br />Mr. Zitzloff responded that discussions regarding the issue began months ago. <br /> <br />City Engineer Jankowski noted that the application was received on August 19, 1999. <br /> <br />City Attorney Goodrich suggested to move the issue forward to have Mr. Zitzloff contact the <br />railroad and determine the permits needed to get under the railroad and drain into the pond. Staff <br />will prepare an ordinance to establish a sub watershed district and schedule a public hearing and <br />have the City Engineer do the feasibility study. <br /> <br />Councilmember Hendriksen inquired as to what is sufficient time for a feasibility study. <br /> <br />City Engineer Jankowski stated that he would have to have dialogue with adjacent property <br />owners within the area to determine how much drainage they would like provided. He explained <br />that he could provide a feasibility study with 85 percent impervious, but does not think it would <br />be well received. <br /> <br />Councilmember Hendriksen suggested that the City Engineer make an initial contact and to get <br />some kind of a reading, but in an absence of a reading the process should not be held up since the <br />other property owners will be allowed to address the Council during a public hearing. <br /> <br />City Council/October 12, 1999 <br /> Page 10 of 25 <br /> <br /> <br />
