If after inspection by the City, a lot proposed for an individual sewage
disposal system is determined unsuitable for that purpose, said lot(s) shall
not be approved for disposal of waste and, if the lot(s) is contained in a plat,
said plat shall not be approved. Construction of such a system on said
property shall constitute a violation of this Chapter.

The subdivision shall not be approved until all new lots proposed for an
individual sewage disposal system are found suitable for that purpose, as
defined by this and the City Code.

e. All soil tests required herein shall be conducted by a registered engineer,
whose expense shall be paid by the subdivider.
9.50.30
Suhd. 10. Park and Open Space Dedication

Purpose. The Council recognizes it is essential to the health, safety and
welfare of the residents of the City and persons working in the City, that the
character and quality of the environment be considered to be of major
importance in the planning and development of the City. In this regard, the
manner in which land is developed and used is of high priority. The
preservation of land for park, playground and public open space purposes as
it relates to the use and development of land for residential,
commercial/industrial purposes is essential to the maintaining of a healthful
and desirable environment for all citizens of the City. The City must not
only provide these necessary amenities for our citizens today, but also be
insightful to the needs of our future citizens.

It is recognized by the Council that the demand for park, playground and
public open space within a municipality is directly related to the density and
intensity of development permitted and allowed within any given area.
Higher density developments mean greater numbers of people and an
increased demand for parks, recreational resources and public open space.
To disregard this principle is to inevitably over-tax existing facilities and
thus, diminish the quality of the environment for all.

The City's Comprehensive Park and Open Space Plan establishes minimum
community criteria for meeting the needs of the residents of City.

It is the policy of the City that the following standards and guidelines for the
dedication of land for park, playground, and public open space purposes (or
cash contributions in lieu of such dedication) in the subdividing and
developing of land within the City shall be directly related to the density and
intensity of each subdivision and development. It is further the policy that it
is intended that subdivision dedication shall first be allocated toward
deficiencies in the subdivision, neighborhood or specific district park(s),
then to trails linking parks, then community parks, then multi-jurisdictional

9.50 Subdivision R~egulations

[:

9-31

August 2003 Draft
