which a structure which is required to have an <br />individual sewage treatment system is located, <br />shall sell or transfer to another party said <br />tract of land unless requirements as stated in <br />Sections 8.30.04 d. 3-6 of this SECTION are <br />met. <br /> <br />(b) <br /> <br />(c) <br /> <br />In designated Shoreland Management Areas, <br />failing on-site sewage treatment systems shall <br />be recon-structed pursuant to MN RULES Chapter <br />6120 of 1989, known as "Statewide Standards <br />for Management of Shoreland Areas" <br /> <br />At any time the Department deems appropriate <br />such as upon receiving a complaint or other <br />information of system failure. <br /> <br />o <br /> <br />(d) <br /> <br />Addition of a bedroom on the property, or a <br />variance issued in accordance with MN RULES <br />Chapter 7080.0305 Subp. 3 (General <br />Requirements for Local Units of Government), <br />subject to the following: <br /> <br />(i) <br /> <br />If a request for an additional bedroom or <br />variance is received between November 1 <br />and April 30 the city may issue a permit <br />or variance immediately with the <br />requirement that a compliance inspection <br />be completed by the following June 1 and <br />the applicant submits a certificate of <br />compliance by the following September 30. <br /> <br />(2) <br /> <br />If a system constructed between May 27, <br />1989 and January 23, 1996 does not comply <br />with applicable requirements, and is not <br />an imminent public health tract, a <br />property owner applying for a zoning <br />permit to construct a bedroom addition <br />has five (5) years from the date of <br />issuance of such zoning permit to bring <br />the system into compliance. <br /> <br />Failing Septic Systems. A Notice of Noncompliance <br />shall be issued and copies provided to the property <br />owner and the City within 30 days under the <br />following conditions: <br /> <br /> I <br /> <br /> I <br /> I <br />I <br />I <br />I <br />I <br />I <br /> <br />(a) <br /> <br />A failed tSTS shall be upgraded, replaced or <br />repaired in compliance with MN RULES Chapter <br />7080.0060, as applicable within one (1) year <br />of the date of Notice of Non-Compliance.
