The Replacement Plan shall <br />identify the location and design of the ISTS <br />and a schedule for its replacement. Failure to <br />submit and execute an acceptable Replacement <br />Plan is a violation of this SECTION. <br /> <br />The Department may not require recertificati0n of <br />an ISTS within two (2) years of its certification <br />date provided the system does not fail or become an <br />imminent public health threat or other cause as <br />deemed appropriate by the Department. <br /> <br />3. Sale or Transfer of Property. <br /> <br />(a) <br /> <br />(b) <br /> <br />(c) <br /> <br />(d) <br /> <br />A certificate of Compliance shall be provided <br />by the seller to the buyer at or before the <br />closing. <br /> <br />The Certificate of Compliance shall be <br />completed by an Inspector and shall indicate <br />that the ISTS is in compliance with MN RULES <br />Chapter 7080 as amended. <br /> <br />In the event that one of the exemptions listed <br />in Subdivision 8.30.04 d 4 and 5 of this <br />SECTION applies, the Certificate must be <br />signed by both parties to the transaction. <br /> <br />The Certificate shall be filed with the Anoka <br />County Auditor along with the Certificate of <br />Real Estate Value. A copy of the Certificate <br />of Compliance shall also be filed with the <br />Department. <br /> <br />o <br /> <br />Exempt Transactions.
