II. <br /> <br /> Nonbinding Memorandum of Understanding <br /> <br />1. All parties acknowledge that this Memorandum of Understanding <br />(MOU) is a nonbinding statement of intent. <br />Conditions <br /> <br />1. The State will issue the Developer a temporary access permit to <br />TH 10 from the Developer's property after l~he MOU has been signed <br />by all parties. <br /> <br />2. The State and the City will collaboratively develop a short <br />frontage road from the Developers property to and including the <br />access on the adjacent property to the west known as Anoka-West <br />Pet Hospital. There will be no cost to the Developer or the City for <br />the construction. <br /> <br />3. The City will use its best efforts to secure an agreement with the <br />property owner west of the Developer to allow the combined access <br />on the property. Also, an easement for access will be signed by <br />both the Developer and the Anoka-West PetHospital. <br /> <br />4. When the construction of the frontage road is completed the <br />Developer will allow the State to remove the temporary access <br />connection to TH 10. <br /> <br />5. The Developer will construct a right turn lane per Mn/DOT <br />specifications and the temporary entrance on TH 10 as shown in the <br />site development plan dated August 1, 1997. <br /> <br /> 2 <br /> <br /> <br />
