Couneilmember <br /> <br />moved for the adoption of the following resolution: <br /> <br />RESOLUTION #98-03- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT TO ESTABLISH ACCESSORY <br />OUTDOOR RECREATIONAL USES TO A RESTAURANT AND BAR <br /> <br /> WHEREAS, Diamond Sports Bar & Grill, Inc., hereinafter referred to as "Applicant", <br />has properly applied for a Conditional Use Permit to establish accessory outdoor recreational <br />uses to a proposed restaurant and bar on the property legally described as follows: <br /> <br />Outlot C, TOOTH ACRES, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Planning Commission for a public hearing pursuant <br />to Section 9.03.04 of the Ramsey City Code on March I2, I998, and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />by reference. <br /> <br />That the subject property is located in the B-3 Highway Business District and is <br />approximately 16.6 acres in size. <br /> <br />That the surrounding parcels to the South and east are part of the Mississippi West Regional <br />Park and the property to the west is zoned B-3 Highway Business; the Subject Property is <br />bounded by Hwy. #10 on the north. <br /> <br />That Section 9.20.23 (B-3 Highway Business District) of the Ramsey City Code establishes <br />that commercial recreational uses, on-sale liquor establishments, and eating establishments <br />are permitted uses within that District. <br /> <br />That the City has established a policy of requiring conditional use permits for outdoor <br />recreational uses in the commercial districts. <br /> <br />That the Applicant is proposing to develop a bar and restaurant on the Subject Property that <br />will include outdoor recreational activities to include three (3) softball fields and five (5) <br />volleyball courts for summer use and two (2) broomball courts for winter use. <br /> <br />That the Applicant has submitted a site plan prepared by New View Construction, Inc., dated <br />February 16, 1998. <br /> <br />That the City has granted a similar conditional use, on a smaller scale, in the same B-3 <br />Highway Business District. <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />I' <br /> I <br /> I <br /> I <br /> I <br />I <br />I <br />I <br /> <br />I' <br />I <br /> <br /> <br />
