I
I

DEVELOPMENT MORATORIUM ISSUES
By: William Goodrich, City Attorney

Background:

At the Council meeting on March 10, 1998, the Council expressed some interest in repealing the
development moratorium as it relates to commercial/industrial properties outside of the MUSA
boundary. Staff was directed to consult with the City's Comprehensive Planners on this subject.
The City has received a memorandum bom Brad Scheib of the Hoisington Koegler Group, a
copy of which is enclosed. You will note Mr. Scheib recommends that the City n0.t. release any
of the areas currently in the moratorium at this time in order to protect the Comprehensive
Planning process.

Recommendation:

Staff recommends acceptance of the Hoisington Koegler Group's recommendation as contained
in the attached March 18, 1998 memorandum. For this reason, we are not presenting an
ordinance to lift the moratorium.

Council Action:

Based upon discussion.

Review Checklist:

City Attorney
City Administrator
Zoning Administrator

CC: 03/24/98

Moratori.doc
