CASE # CONSIDER ORDINANCE TO AMEND CRITICAL RIVER REGULATIONS By: Zoning Administrator Sylvia Frolik Background: ' That portion of the Mississippi River located in Ramsey is subject to both the Critical River regulations and the Wild and Scenic River regulations. Minimum State rules include language which prohibits the sale of lawful non-conforming lots as building sites if they are owned by an adjacent property owner. MN rules also establish a minimum structure setback from the river of 20 feet from bluff and 100 feet from ordinary high water. Because Ramsey's ordinance was never approved by the Environmental Quality Board, we are subject to the interim guidelines established in the Governor's Executive Order 79-19. Those interim guidelines call for a 200 foot structure setback from ordinary high water mark or 100 foot from bluff line. Because of a recent case in Ramsey at 14620 Bowers Drive in which the applicant was granted a variance to the dual ownership role and the structure setback from river, the Council has requested that the City Staff initiate an ordinance to amend these sections of City Code. This amendment is subject to the review of the Metro Council and approval of the DNR. An excerpt of City Code with bolds and strikeouts to reflect the proposed changes and the proposed ordinance to enact these changes in text are enclosed for review. The Planning Commission conducted a public hearing regarding the proposed ordinance on April 7, 1998. The City received a letter from Tom Hovey at the DNR dated April 7, 1998, which indicates that for reasons stated in the letter, DNR certification of these proposed amendments is not likely. A copy of that letter is enclosed for your information. Recommendation: The Planning Commission recommends Council adoption of the proposed ordinance.
