The City herein agrees <br />to the substitution of B-612 concrete curbing along the east edge of the bituminous <br />surface with a bituminous berm in order to facilitate a future expansion of the r.v. facility. <br />It is herein agreed that if said expansion of the bituminous surface onto the adjacent <br />property to the east does not occur within a five (5) year time frame, then the property <br />owner shall be responsible for replacing the bituminous berm with B-612 concrete <br />curbing by October 1, 2003. Failure to comply with this requirement shall serve as a <br />basis for denial of any City license required to conduct business on the Site. <br /> <br />FIRE LANES. Fire lanes shall be maintained on the Site. The exact location of these <br />items on the Site shall be as directed by the City's Fire Chief. <br /> <br />LIGHTING. <br />Engineer. <br /> <br />Any lighting installed on the site is subject to prior approval by'the City <br /> <br />BUILDING FACADE. The Permittee agrees to construct the Structure with textured <br />concrete block in accordance with the Building Elevations prepared by Design Resource <br />Group, dated May 18, 1998, Revision Date June 2, 1998. <br /> <br />REQUIREMENTS FOR BUILDING PERMIT AND CERTIFICATE OF <br />OCCUPANCY. No building permit for the Site will be issued until the permittee has: a) <br />signed and returned this Development Permit; b) provided the required financial <br />guarantee in accordance with Paragraph 11 of this Permit. No Certificate of Occupancy <br />for the structure will be issued until the Required Improvements, or a financial surety for <br />the Required Improvements, are accepted by the City and the landscaping maintenance <br />guarantee has been provided in accordance with Item #12 of this Development Permit.. <br /> <br />IMPROVEMENT CONSTRUCTION SCHEDULE. The Required Improvements <br />shall be completed before June 30, 1999. <br /> <br />12. <br /> <br />13. <br /> <br />STORMWATER MANAGEMENT-FEE The City has enacted a Stormwater <br />Management Fee in the amount of Three Thousand Five Hundred Seventy Seven Dollars <br />per commercial acre. The amount of Stormwater Management Fee due on the Site is <br />Four Thousand Two Hundred Fifty Seven Dollars ($4,257.00) (1.19 acres x $3577/acre). <br />The Stormwater Management Fee will be used to cover costs incurred to provide an <br />eventual outlet to the Mississippi River from the ponded storm water system. <br /> <br />ESCROW FOR REQUIRED IMPROVEMENTS. In order to insure the installation of <br />the Required Improvements in accordance with City specifications and in a timely <br />manner, the Permittee shall be required to deposit with the City a cash escrow or letter of <br />credit, approved as to form by the City, in the amount of Forty Eight Thousand Five <br />Hundred Dollars ($48,500.00), which is 150% of the City's estimated cost of the <br />Improvements. Prior to the issuance of the building permit, all financial guarantees must <br />be provided as required herein. <br /> <br />Upon completion of the construction of the Required Improvements, the financial <br />guarantee shall be returned to the Permittee and the Permittee shall be required to provide <br />the landscaping maintenance guarantee described in Item #13 of this Development <br />Permit. The determination of completion of the construction of the Required <br />Improvements shall be made by the' City Council after consultation with the City <br /> <br /> <br />
