The City herein agrees to the substitution of B-612 concrete curbing along the east edge of the bituminous surface with a bituminous berm in order to facilitate a future expansion of the r.v. facility. It is herein agreed that if said expansion of the bituminous surface onto the adjacent property to the east does not occur within a five (5) year time frame, then the property owner shall be responsible for replacing the bituminous berm with B-612 concrete curbing by October 1, 2003. Failure to comply with this requirement shall serve as a basis for denial of any City license required to conduct business on the Site. FIRE LANES. Fire lanes shall be maintained on the Site. The exact location of these items on the Site shall be as directed by the City's Fire Chief. LIGHTING. Engineer. Any lighting installed on the site is subject to prior approval by'the City BUILDING FACADE. The Permittee agrees to construct the Structure with textured concrete block in accordance with the Building Elevations prepared by Design Resource Group, dated May 18, 1998, Revision Date June 2, 1998. REQUIREMENTS FOR BUILDING PERMIT AND CERTIFICATE OF OCCUPANCY. No building permit for the Site will be issued until the permittee has: a) signed and returned this Development Permit; b) provided the required financial guarantee in accordance with Paragraph 11 of this Permit. No Certificate of Occupancy for the structure will be issued until the Required Improvements, or a financial surety for the Required Improvements, are accepted by the City and the landscaping maintenance guarantee has been provided in accordance with Item #12 of this Development Permit.. IMPROVEMENT CONSTRUCTION SCHEDULE. The Required Improvements shall be completed before June 30, 1999. 12. 13. STORMWATER MANAGEMENT-FEE The City has enacted a Stormwater Management Fee in the amount of Three Thousand Five Hundred Seventy Seven Dollars per commercial acre. The amount of Stormwater Management Fee due on the Site is Four Thousand Two Hundred Fifty Seven Dollars ($4,257.00) (1.19 acres x $3577/acre). The Stormwater Management Fee will be used to cover costs incurred to provide an eventual outlet to the Mississippi River from the ponded storm water system. ESCROW FOR REQUIRED IMPROVEMENTS. In order to insure the installation of the Required Improvements in accordance with City specifications and in a timely manner, the Permittee shall be required to deposit with the City a cash escrow or letter of credit, approved as to form by the City, in the amount of Forty Eight Thousand Five Hundred Dollars ($48,500.00), which is 150% of the City's estimated cost of the Improvements. Prior to the issuance of the building permit, all financial guarantees must be provided as required herein. Upon completion of the construction of the Required Improvements, the financial guarantee shall be returned to the Permittee and the Permittee shall be required to provide the landscaping maintenance guarantee described in Item #13 of this Development Permit.
