I I I I I I I I I I I I I I I I I I I CASE REQUEST FOR A CONDITIONAL USE PERMIT TO GRADE AND IMPORT SOILS; CASE OF NORTH FORK, INC. By: City Engineer Steve Jankowski Background: On June 23, 1998, North Fork, Inc. submitted an application to the City for a conditional use permit to grade two sites in the Northfork subdivision. Site A is Lots 7 and 8 of Northfork and Site B is Lots 5, 6, 7 and 8 of the Northfork Links Addition. The proposal for Site A is to regrade the lots to accommodate walk-out style homes. The proposal for Site B is to complete the grading and importing of soils to achieve elevations approved in the grading plan associated with a conditional use permit issued in 1995 that has now expired. The following items are enclosed: 1. Site location map 2. Grading plan for Site A and Applicant's project description dated July 1, 1998 3. Grading plan for Site B and Applicant's project description dated July 1, 1998 4. Draft Planning Commission public hearing and meeting minutes dated July 7, 1998 5. Proposed findings of fact 6. Proposed conditional use permit Notification: State statute requires notification of the public heating to property owners within 350 feet of the subject property. Staff attempted to notify property owners within 500 feet of the subject sites of the public hearing date. Observations: The grading of Site A entails placing the foundation for each of the two future homes at the existing grade and building up the grade from four to six feet surrounding the front of the structure. At the Planning Commission meeting, the owner of the adjacent property to the west was present and agreed to allow his property to be regraded to improve drainage for all three lots. The Planning Commission recommended approval of the grading permit contingent upon a revised grading plan to be approved by the City Engineer which would include a minimum of 1½ percent slope on the swale leading from the walkout pads.
