Councilmember <br />adoption: <br /> <br />introduced the following resolution and moved for its <br /> <br />RESOLUTION #98-08- <br /> <br />A RESOLUTION ADOPTING FINDING OF FACT # RELATING TO A REQUEST <br />FROM GERALD BAUER FOR A CONDITIONAL USE PERMIT TO GRADE AND <br />EXPORTS SOILS <br /> <br /> WHEREAS, the City of Ramsey received an application'from Gerald Bauer for a <br />conditional use permit to grade and export excess soils from the pboperty legally described as <br />follows: <br /> <br />The Northeast Quarter of the Northwest Quarter and the Northwest Quarter of the <br />Northeast Quarter of Section 29, Township 32, Range 25, Anoka County, Minnesota, <br />lying north of the Burlington Northern Railroad easement. <br /> <br />The south 370 feet of Outlot A, Block 1, Pine Shadows, Anoka County, Minnesota. <br /> <br />(the "Subject Property"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />That on June 12, 1998, Gerald Bauer, hereinafter referred to as "Applicant", applied for a <br />conditional use permit to grade and export excess soils from the Subject Property. <br /> <br />That the applicant appeared before the Ramsey Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the City Code on July 7, 1998, which was also continued to <br />August 4, 1998 for additional information, and that said public hearing was properly <br />advertised and that the minutes of said public hearing are hereby incorporated as a part of <br />these findings by reference. <br /> <br />That the Applicant has submitted a Grading Plan prepared by Lot Surveys Company, Inc. <br />dated March 18,I998. <br /> <br />That the Applicant is proposing to grade an area of 65 acres to an elevation which will <br />require exporting approximately 692,573 cubic yards of earth material from the Subject <br />property. <br /> <br />That the Grading Plan identifies a proposed haul road to be across Lot 2, Block 1, HY-10 <br />Ramsey 2nd Addition; and then onto Armstrong Blvd. NW <br /> <br /> I <br /> I <br /> I <br /> I <br /> i: <br /> <br /> I <br /> I <br />I <br />I <br />I' <br />I: <br />I <br />I <br />i <br />I <br /> <br />I <br />I <br /> <br /> <br />
