Councilmember adoption: introduced the following resolution and moved for its RESOLUTION #98-08- A RESOLUTION ADOPTING FINDING OF FACT # RELATING TO A REQUEST FROM GERALD BAUER FOR A CONDITIONAL USE PERMIT TO GRADE AND EXPORTS SOILS WHEREAS, the City of Ramsey received an application'from Gerald Bauer for a conditional use permit to grade and export excess soils from the pboperty legally described as follows: The Northeast Quarter of the Northwest Quarter and the Northwest Quarter of the Northeast Quarter of Section 29, Township 32, Range 25, Anoka County, Minnesota, lying north of the Burlington Northern Railroad easement. The south 370 feet of Outlot A, Block 1, Pine Shadows, Anoka County, Minnesota. (the "Subject Property"). NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are determined to be as follows: That on June 12, 1998, Gerald Bauer, hereinafter referred to as "Applicant", applied for a conditional use permit to grade and export excess soils from the Subject Property. That the applicant appeared before the Ramsey Planning Commission for a public hearing pursuant to Section 9.03.04 of the City Code on July 7, 1998, which was also continued to August 4, 1998 for additional information, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. That the Applicant has submitted a Grading Plan prepared by Lot Surveys Company, Inc. dated March 18,I998. That the Applicant is proposing to grade an area of 65 acres to an elevation which will require exporting approximately 692,573 cubic yards of earth material from the Subject property. That the Grading Plan identifies a proposed haul road to be across Lot 2, Block 1, HY-10 Ramsey 2nd Addition; and then onto Armstrong Blvd. NW I I I I i: I I I I I' I: I I i I I I
