Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #98-08- RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT TO GRADE SOILS WHEREAS, the Ramsey City Council adopted Resolution No. 98-08- adopting Findings of Fact # . for this use and herein approves the Conditional Use Permit subject to the following conditions. .. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On , 1998 a Conditional Use Permit ("CLIP") was issued by the City of Ramsey ("City") to Ronald J. Kabat ("Permittee") for grading operations on the property legally described as follows: Lot 4, Block 5, Fox Ridge Estates 2nd Addition, ANOKA COUNTY, MINNESOTA ("Subject Property:") .This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. conditions of this permit are as follows: This permit shall expire three (3) years from the date of commencement of operations and the Permit Holder shall be responsible for providing the City with at least 48 hours advance notice of the date of commencement of operations. The Permit Holder shall be responsible for immediately removing any spilled material fi.om the public roads upon direction to do so by the City Engineer. Failure to do so shall be cause for the City Engineer to order the necessary work to be done and billed to the Permit Holder. All grading operations shall be conducted in accordance with the three (3) sheet plan submitted by the Permittee in conjunction with the application and dated received by the City on July 15, 1998. Grading shall require finished grade areas to be restored with six (6) inches of topsoil, seed and disc anchored mulch. All equipment used for grading operations shall be maintained and operated in such a manner to minimize noise, dust, and vibrations adversely affecting surrounding properties. Ail equipment shall be kept in good repair. Failed equipment and rubbish shall be removed from the work site regularly. Except for the Permittee's personal equipment and property, only equipment required for the excavation and grading materials shall be allowed onto the site. Equipment associated with the processing of the excavated materials such as crushers, washers, conveyors, etc., are prohibited.
