SECTION 5. TIMETABLE. <br /> The parties shall make good ?aith efforts to observe the following timetable in performing <br /> <br />their respective duties: <br /> <br />A. City A~quisition of Land November, 1998 <br />B. Bond Closing November, 1998 <br />C. Conveyance of Land to ACHRA At Bond Closing <br />D. Completion of Construction August~, 1999 <br /> <br />SECTION 6. MISCELLANEOUS PROVISIONS. <br /> <br /> A. Dispute Resolution. In the event of a dispute arising under the Joint Powers <br /> <br />Agreement that cannot be resolved by mutual agreement of the parties, the parties agree to <br />attempt to resolve their disputeby following the process described below. <br /> <br /> 1) A party shal.1 provide written notice to the other party describing perceived <br /> <br /> conflict, positions and underlying reasons. <br /> <br /> The party shall provide written response to notice within 7 days of receipt <br /> <br /> 2) <br /> <br />of notice. <br /> <br /> 3) <br /> <br /> The parties shall meet within 14 days of receipt of response with a neutral <br />facilitator. The neutral facilitator will be' a representative from the Minnesota Office of <br />Dispute Resolution. <br /> <br /> 4) At the first meeting, the neutral facilitator will assist the parties in <br /> <br />identifying the appropriate parties and participants in the dispute resolution process, their <br />concerns, a meeting agenda and design for any subsequent meetings.
