Norman, City Administrator <br /> <br />Background: <br /> <br />The City has been working with Dolphin Real Estate Partnership so as to allow the <br />construction of a new Burger King located at the intersection of T.H. #10 and Ramsey <br />Boulevard. As part of that process, the Minnesota Department of Transportation <br />(MnDOT) has requested that the proposed Burger King operation not add a separate <br />access to T.H. #10 but to develop an agreement with the pet hospital for access utilization <br />of both entities. As part of the negotiations, MnDOT has agreed to pay up to $40,000 for <br />the improvements for a single access of the two entities. To complete the understanding, <br />the City has been asked to develop the proposed easement agreement and administer all <br />the elements of the access easement agreement. <br /> <br />Easement Agreement and Recommendation: <br /> <br />City Attorney Bill Goodrich has drafted a proposed easement agreement for all the <br />parties. (The agreement is included with this case.) The agreement basically would <br />allow the utilization of the current pet hospital access for both the pet hospital and Burger <br />King as access to T.H. #10. MnDOT would provide up to $40,000 for the improvements <br />of said access and the City would provide the administration and accounting of the <br />disbursements for the improvements.
