Absent: CouncilmemberBeyer. <br /> <br />COUNCH~ BUSINESS <br /> <br />Case #1: Consider Restoration of Drainage Easement on Lots 1 and 2, Block 2, Pondvale <br /> Estates 2nd Addition <br /> <br />City Engineer Jankowski explained that at the September 16, 1998 Road and Bridge Committee <br />meeting, the issue of the partial filling of a drainage and utility easement on Lots 1 and 2, Block 2, <br />Pondvale Estates 2nd Addition was addressed. These two lots, along with Lot 3, are owned by <br />Jennifer and Todd Asmussen who appeared at the September 8, 1998, Council meeting during <br />Citizen Input and indicated the filling of the lots was an attempt to stabilize a chronic erosion <br />problem in the depression that was constructed within the easement. Mr. Jankowski explained <br />that the purpose of the easement is to contain storm water coming off Helium Street and to <br />prevent discharge of this water onto the adjoining property over which the City has no easement. <br />The Road and Bridge Committee suggested that a policy be formulated to address the <br />responsibilities associated with such easements, and also directed that the City rectify this <br />particular situation to the satisfaction of the property owner. To accomplish this, Staff is <br />recommending that the fill be removed and the depression regrading to its pre-filled contours, that <br />four inches of top soil be spread over the side slopes, and that sod be placed on the side slopes to <br />control erosion and provide an aesthetic appearance. The cost of this work is estimated to be <br />$3,500 would could be financed from the Public Improvement Revolving (Pig) Fund. Mr. <br />Jankowski stated it is the recommendation of the Road and Bridge Committee to restore and <br />stabilize the drainage and utility easement on Lots 1 and 2, Block 2, Pondvale Estates. <br /> <br />Councilmember Haas Steffen inquired regarding the timing of this project. <br /> <br />Mr. Jankowski stated it will probably be a spring project. <br /> <br />Councilmember Haas Steffen asked if the Asmussen's are satisfied with this'proposal. <br /> <br />Todd Asmussen, applicant, stated he received a letter but did not understand what was being <br />proposed. He suggested it would defeat the purpose if the fill he placed were to be removed. He <br />explained that the entire lot is sand and what he put into place was to bring it back to the <br />condition of when he moved in. <br /> <br />Mr. Jankowski stated there is a depression to hold the water and prevent it from traveling onto <br />the neighboring property.
