I <br /> I <br />I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br />'1 <br />I <br /> I <br /> I <br /> <br />Councilmember Haas Steffen asked the City Attorney to address whether there is a time limit on <br />this case and Agenda Item 7. <br /> <br />Case #lB: Modification to Diamonds Sports Bar Site Plan; Case of Gary Gruber <br /> <br />Zoning Administrator Frolik explained the owners of the Diamonds Sports Bar & Grill, Inc. have <br />approached the City with a request for some modifications to their site and landscape plans. The <br />first issue is the request for an accessory building on the site in which to store equipment primarily <br />for grounds maintenance. The second issue is the landscaping plan which has two parts. The first <br />part is Mr. Gruber's proposal to eliminate the 30 trees required to be planted along the T.H. #10 <br />corridor. The second part is a request to replace the vines to be planted along the perimeter of <br />the chain link fence with tree seedlings. Public hearings are not a requirement for site plans or <br />modifications to site plans. However, several residents had expressed concern for the <br />development project at the public hearing held for the issuance of a conditional use permit for the <br />outdoor recreational activities to be conducted at the site. Staff notified these residents of record <br />of the proposed site plan modifications to be presented to the Planning Commission on October 6, <br />1998. Ms. Frolik stated that on October 6, 1998, the Planning Commission heard Mr. Gruber's <br />proposal for the addition of an accessory building to the site and the landscape modifications. <br />With respect to the 400 square foot accessory building, Mr. Gruber is proposing grooved <br />plywood siding painted "barn red" to match the trim on the principal building with asphalt <br />shingles on the roof. City Code establishes that all exterior finishes in the Commercial District <br />shall be natural or prefabricated stone and any deviation from that is at Council's discretion. City <br />Code restricts accessory buildings in the B~3 Highway Business District to 30% of the gross floor <br />area of the principal building. The principal building exceeds 8,000 square feet in size and the 400 <br />square foot structure will be well within Code restrictions for accessory building sizes, as well as <br />the 35% lot coverage restriction. Mr. Frolik stated one resident from Alpaca Estates expressed <br />concern for the proposed modifications to landscaping, particularly replacing fence vinery with <br />tree seedlings. After a lengthy discussion, the Planning Commission tabled action on that portion <br />of the landscape modification and Mr. Gruber was directed to prepare an amendment landscape <br />plan for the Planning Commission's review at a subsequent meeting. With respect to the request <br />to eliminate 30 tree plantings required along the T.H. #10 corridor, the Planning Commission <br />recommended that the number of trees to be planted be reduced from 30 to 18 and that they be <br />planted along the west property line to intensify the visual and noise screening from the Alpaca <br />Estates residents. The basis for this recommendation to reduce and relocate the number of tree <br />plantings is based on the fact that, through a self-imposed change in construction methods, <br />numerous trees were preserved on the site, especially on the T.H. #I0 corridor, and the <br />Commission did not feel it was a priority to screen the facility from T.H. #10. The Planning <br />Commission has recommended approval of the proposed accessory building in accordance with <br />City Code, approval of the additional building and its size but that a wood versus natural or <br />prefabricated stone exterior finish is a Council decision. The Planning Commission also <br />recommended approval of that part of the landscape plan that would reduce the number of <br />required tree plantings from 30 to 18 and relocate them from the north to the west property line. <br />It is hopeful that expedient action on the part of City Council with respect to this part of the <br />landscape modifications will allow the developer to plant these trees prior to ground freeze. <br /> <br />I <br /> <br />City Council/October 13, 1998 <br /> Page 9 of 22 <br /> <br /> <br />
