~ECTION 5. APPLICABILITY. <br /> <br /> The moratorium adopted by this Ordinance applies only to that <br />Certain real property within the City legally described as follows: <br /> <br />That part of Section 24, Township 32, Range 25, Anoka <br />County, Minnesota described as follows: <br /> <br />Government Lots 2 and 3; and the Southwest Quarter of the <br />Northwest Quarter, except the South 660.0 feet of the <br />West 181.5 feet; and the Southeast Quarter of the <br />Northwest Quarter, except the West 1206.0 feet and except <br />the South 660.0 feet; and EXCEPT those portions platted <br />as REILLEY ESTATES and REILLEY ESTATES 3RD ADDITION. <br /> <br />BECTION 6. UNDUE HARDSHIP EXCEPTIONS. <br /> <br /> The City Council may grant an exception to the provisions of <br />this Ordinance when, in its opinion, undue hardship may result from <br />strict compliance. In granting an exception, the City Council <br />Shall prescribe any conditions that it deems necessary to or <br />~esirable for the protection of the public interest. No exception <br />shall be granted unless the city Council finds: <br /> <br />That there are special circumstances or conditions <br />affecting said property such that the strict application <br />of the provisions of this Moratorium Ordinance would <br />deprive the petitioner of the reasonable use of <br />petitioner's land. <br /> <br />That the exception is necessary for the preservation and <br />enjoyment of a substantial property right of the <br />petitioner. <br /> <br />That the granting of the exception will not be <br />detrimental to the public welfare or injurious to other <br />property in the area in which the property is situated. <br /> <br />That the proposed exception will be harmonious with and <br />in accordance with the specific objectives of the City's <br />existing Comprehensive Plan and will not adversely affect <br />the planning process for adoption of amendments to the <br />Comprehensive Plan above described. <br /> <br />That the proposed use/subdivision will be consistent with <br />the intent and purpose of this Ordinance. <br /> <br />BECTION 7. TERM. <br /> <br /> The term of this Ordinance shall be for a period of ninety <br /> 90) days commencing with its effective date. The term may be <br />Extended after approval by the city Council for an additional <br /> <br />2 <br /> <br /> <br />
