CASE <br /> <br /> CONSIDER ORDINANCE TO AMEND CRITICAL RIVER REGULATIONS <br /> By: Zoning Administrator Sylvia Frolik <br />Background: <br /> <br />That portion of the Mississippi River located in Ramsey is subject to both the Critical River <br />regulations and the Wild and Scenic River regulations. Minimum State rules include language <br />which prohibits the sale of lawful non-conforming lots as building sites if they are owned by an <br />adjacent property owner. MN rules also establish a minimum structure setback from the river of <br />20 feet from bluff and 100 feet from ordinary high water. Because Ramsey's ordinance was <br />never approved by the Environmental Quality Board, we are subject to the interim guidelines <br />e~tablished in the Governor's Executive Order'79-19. Those interim guidelines call for a 200 <br />foot structure setback from ordinary high water mark or 40 foot from bluff line. <br /> <br />Because of a recent ease in Ramsey at 14620 Bowers Drive in which the applicant was granted a <br />variance to the dual ownership rule and the structure setback from river, the Council has <br />requested that the City Staff initiate an ordinance to amend these sections of City Code. This <br />amendment is subject to the review of the Metro CouneiI and approval oft_he DNK. An excerpt <br />of City Code with bolds and strikeouts and the proposed ordinance are enclosed for review. <br /> <br />Recommendation: <br /> <br />At the date of this writing, the City has not received any comments from DNR regarding the <br />proposed amendment.
