Commencing at Point B heretofore mentioned; then north and parallel with the West Line of said Southwest Quarter of the Northwest Quarter for a distance of 496.01 feet; then northerly in a straight lin.e to a point on the North Line of said Southwest Quarter of the Northwest Quarter a distance of 1100 feet east from the northwest comer of said Southwest Quarter of the Northwest Quarter and there terminating. (the "Subject Property"). NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are determined to be as follows: That on July 7, 1998, Mark and Doni Heule, hereinafter referred to as "Applicants", properly applied for a conditional use permit for a private dog kennel to maintain more than two adult dogs on the Subject Property. That the applicants appeared before the Ramsey Planning Commission for a public hearing pursuant to Section 9.03.04 of the City Code on July 7, 1998, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. 3. That the Subject Property and surrounding parcels are zoned R-1 Rural Residential. 4. That the Subject Property is approximately 3.9 acres in size. 5. That Section 9.02 of the Ramsey City Code defines dog kennel as any place where three or more dogs over three months of age are kept. 6. That Section 9.20.11 (P,-1 Rural Residential District) does not establish dog kennels as a permitted use of property in this District. That the Applicants stated that they were unaware of the restriction on the number of dogs that may be kept on a parcel without a special permit and have been maintaining eight (8) show dogs at the Subject Property for the past 7 years. That the Applicants have submitted a letter which explains that they raise show dogs, currently eight (8) Belgian Tervurens, that reside in the home and no more than three (3) dogs at a time are allowed outdoors in a fenced two acre exercise area, and no dogs are allowed outdoors unless at least one of the Applicants is home.
