Councilmember <br /> <br />RESOLUTION <br />BASED ON FINDINGS OF FACT # <br />GRADE AND EXPORT SOILS <br /> <br /> introduced the following resolution and moved for its adoption: <br /> RESOLUTION #98-07- <br /> <br />APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br /> ~ AND DECLARING TERMS OF PERMIT TO <br /> <br /> WHEREAS, the Ramsey City Council adopted Resolution No. 98-07- adopting Findings <br />of Fact # for this use and herein approves the Conditional Use Permit subject to the following <br />conditions. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On ., 1998 a Conditional Use Permit ("CUP") was issued by the City of Ramsey ("City") <br />to Michael LeBlanc ("Permit Holder") for grading operations on the property legally described as <br />follows: <br /> <br />Lots 1, 2 and 3, Block 1, PINEVIEW ESTATES 2ND ADDITION, ANOKA COUNTY, <br />MINNESOTA <br />("Subject Property:") <br /> <br />This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The <br />conditions of this permit are as follows: <br /> <br />This permit shall expire three (3) years from the date of commencement of operations and the <br />Permit Holder shall be responsible for providing the City with at least 48 hours advance notice <br />of the date of commencement of operations. <br /> <br />The ingress and egress to the Subject Property shall be from the southwestern comer of the <br />site, due south for a distance of approximately 700 feet, then due eastward using a gravel road <br />(constructed by the City for access to Well Nos. 3 and 4) for a distance of V2 mile. Access <br />from the public road system shall be at the intersection of C.R. #116 and C.R. #56. The Permit <br />Holder shall provide a 75 foot long gravel approach at the access point onto Ramsey Blvd. to <br />minimize the tracking of grading materials fi.om the site onto the public highway. The Permit <br />Holder shall be responsible for obtaining and complying with any permits deemed necessary <br />from Anoka County. In addition, the Permit Holder shall be responsible for immediately <br />removing any spilled material from the public roads or the City well road upon direction to do <br />so by the City Engineer. Failure to do so shall be cause for the City Engineer to order the <br />necessary work to be done and billed to the Permit Holder. <br /> <br />o <br /> <br />All grading operations shall be conducted in accordance with the one (1) sheet plan submitted <br />by the Applicant in conjunction with the application.
