CASE # 5 <br /> <br /> REQUEST FOR A CONDITIONAL USE PERMIT <br />TO GRADE AND IMPORT SOILS; CASE OF NORTH FORK, INC. <br />By: City Engineer Steve Jankowski <br /> <br />Background: <br /> <br />On June 23, 1998, North Fork, Inc. submitted an application to the City for a conditional use <br />permit to grade two sites in the Northfork subdivision. Site A is Lots 7 and 8 of Northfork and <br />Site B is Lots 5, 6, 7 and 8 of the Northfork Links Addition. <br /> <br />The proposal for Site A is to regrade the lots to accommodate walk-out style homes. The <br />proposal for Site B is to complete the grading and importing of soils to achieve elevations <br />approved in the grading plan associated with a conditional use permit issued in 1995 that has <br />now expired. <br /> <br />The following items are enclosed: <br /> <br />1. Site location map <br />2. Grading plans <br />3. Two project description letters from Applicant dated July 1, 1998 <br />4. Proposed findings of fact <br />5. Proposed conditional use permit <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to property owners within 350 feet of the <br />subject property. Staff attempted to notify property owners within 500 feet of the subject sites of <br />the public hearing date. <br /> <br />Observations: <br /> <br />The grading of Site A entails placing the foundation for each of the two future homes at the <br />existing grade and building up the grade from four to six feet surrounding the front of the <br />structure. This plan results in the walkout elevation being two feet higher than the lowest point <br />on each lot. A swale having a depth of two feet would convey water from the structure to the <br />western property line, resulting in a swale grade of one percent or less. <br /> <br />The grading request for Site B is summarized quite thoroughly in the July 1, 1998 letter from the <br />Applicant. Additional conditions may be placed in the permit pursuant to public comment. <br /> <br />Recommendation: <br /> <br /> <br />
