13. There shall be no stockpiling of graded materials, other than the topsoil on a temporary <br /> basis, allowed within the boundaries of the Subject Property. <br /> <br />14. <br /> <br />The Permittee shall file with the City a liability insurance policy or certificate of such <br />insurance acceptable to the City and issued by an insurance company authorized to do <br />business in the State of Minnesota. , <br /> <br />15. The policy shall insure the permit holder for the sum of at least $300,000 for injury to one <br /> person and $500,000 for one accident, and at least $1,100,000 property damage. <br /> <br />16. <br /> <br />Said policy shall be for the full period of the permit and shall provide for the giving of 10 <br />days prior notice to the City by registered mail of termination, cancellation or amendment <br />of the policy. <br /> <br />17. <br /> <br />In the event said policy is terminated for any reason, the permit shall be automatically <br />suspended upon the day the policy terminates unless a new policy complying with this item <br />is obtained and filed with the City prior to the termination of the policy in force. <br /> <br />18. <br /> <br />The maximum noise level at the perimeter of the work site shall be within the limits set by <br />the Minnesota Pollution Control Agency and the Environmental Protection Agency of the <br />United States. <br /> <br />19. <br /> <br />All costs incurred by the City in executing and administering this permit shall be the <br />responsibility of the permit holder. The permit holder shall maintain a minimum Five <br />Hundred Dollar ($500.00) balance in an' escrow account with the City. This escrow shall <br />be used to reimburse the City for expenses incurred in the administration of this permit. At <br />the time the mining operation and site restoration are completed to the satisfaction of the <br />City, the balance of the escrow shall be returned to the Permit Holder. <br /> <br />20. All grading operations shall be conducted between 7:00 a.m. and 8:00 p.m. on weekdays <br /> only unless otherwise specifically approved by the City Administrator and/or his designee. <br /> <br />21. <br /> <br />The amount of dust or other particulate matter caused by the mining operation shall not <br />exceed the standards established by the Minnesota Pollution Control Agency. No <br />operation shall be allowed when wind gust exceed 30 miles per hour. <br /> <br />22. <br /> <br />All operations shall comply with all applicable Minnesota Pollution Control Agency <br />regulations and Federal and Environmental Protection Agency regulations for the <br />protection of water quality. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br /> and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />RESOLUTION #98-08- <br />Page 3 of 5 <br /> <br /> <br />
