Since the public hearing notice was published, City Staff has received complaints from <br />neighboring property owners that Mr. Reichert's commercial venture has escalated to a point <br />where he has outside employees. Although City Code provides the oppommity for residents to <br />store their commercial equipment and vehicles at their home provided they are parked indoors or <br />screened to a degree of 75%, it does not mean that they can base a commercial business from <br />their residential property with outside employees. <br /> <br />City Staff is concerned with granting a conditional use permit for an accessory building on a <br />separate lot of record that may never have a home on it. As long as it stays a separate lot of <br />record and is not bound in some way to the l~eichert homestead, it can be sold at any time and <br />may prove to be a breeding ground for future illegal businesses. Staff is also concerned that <br />granting this permit, knowing Mr. Reichert's commercial venture has escalated to include <br />employees, is an invitation to a code enforcement problem. Also, the building size overage <br />requested is significantly larger than what the City has granted in the past in similar situations. <br /> <br />Recommendation: <br /> <br />Based on the observations above, City .Staff is recommending denial of the request for a <br />conditional use permit. <br /> <br />Commission Action: <br /> <br />Motion to: <br />Recommend that City Council adopt Findings of Fact relating to Jim Reichert's request for a <br />conditional use permit. <br /> <br />Motion to: <br />Recommend that City Council deny Jim Reichert's request for a conditional use permit based on <br />the findings of fact. <br /> <br />Review Checklist: <br />Community Development Director <br />Community Development Assistant <br />Building Official <br /> <br />PC: Ii~2~8 <br /> <br /> <br />
