That the Subject Property is included in the Metropolitan Urban Service Area by a <br />Comprehensive Plan amendment approved by the Ramsey City Council on November 9, <br />1993 (Resolution #93-11-268) and the Metropolitan Council on January 12, 1995. <br /> <br />That in a report to the City Council on May 27, 1997, the legal firm of Kennedy & Graven <br />reported to City Council that under present law, all cities must conform their land use <br />regulations in accordance with the comprehensive plan by December, 1998. <br /> <br />I0. <br /> <br />That a Minnesota Supreme Court case has established a precedent that it is arbitrary and <br />capricious for a municipality to refuse to adopt a zoning ordinance implementing its <br />comprehensive plan. <br /> <br />11. <br /> <br />That the Applicant has provided the City with a general development plan dated November <br />13, 1998, reflecting an intent to develop the Subject Property with single family urban <br />residential lots. <br /> <br />12. That the proposed rezoning is in conformance with the Comprehensive Plan. <br /> <br />13. That the proposed zoning amendment will/will not substantially adversely impair the use or <br /> market value of any surrounding property. <br /> <br />14.
