That the Applicant's proposal for 3 lots in 35 acres maintains compliance with the 4 <br />units in 40 acres density restriction and meets the intent of the Comprehensive Plan. <br /> <br />That the Applicant has stated that the current 10 acre minimum lot sizes in the <br />Rural Service Area creates a practical difficulty because the division of the family <br />estate among the Applicant's children w~ established as 2.5 acres per child in <br />1989, prior to the City's affirmation of 4 in 40 density restrictions and the increase <br />to 10 acre minimum lot sizes in the Rural Service Area located generally north of <br />Trott Brook. <br /> <br />10. <br /> <br />That the special conditions causing the practical difficulty, namely the revised lot <br />sizes and density restrictions occurring in 1990. do not result from the actions of the <br />Applicants. <br /> <br />11. That if granted, the variance will/will not grant the Applicant any special privilege <br /> that is denied to other owners of lands in the same district. <br /> <br />12. That if granted, the variance will/will not impair an adequate supply of light and air <br /> to adjacent properties. <br /> <br />13. That if granted, the variance will/will not unreasonably increase the traffic in the <br /> public street. <br /> <br />14. That the variance requested is/is not the minimum necessary to accomplish the <br /> intended purpose of the Applicants. <br /> <br />15. That if granted, the variance will/will not permit a use that is prohibited in the R-I <br /> Rural Residential District. <br /> <br />16. That if granted, the variance will/will not increase the danger of fire or endanger the <br /> public safety. <br /> <br />17. That if granted, the variance will/will not unreasonably diminish established <br /> property values within the neighborhood. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board <br />Member and upon vote being taken thereon, the following voted in <br />favor thereofi <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br />and the following were absent: <br /> <br /> <br />
