He stated that emergency access will be di~cult unless the development <br />is one house per acre. <br /> <br />Mr. Peterson apologized for ~itlng to communicate accurately at the neighborhood meeting. If <br />this proposal is approved, the park dedication fee will be over $126,000 to the City for parks. He <br />agreed with Commissioner Deemer *_hat the access to I-:fighway 47 eau only be temporary and will <br />change if another access is opened in the future. The current property owner has rights to access <br />Iq]ghway 47, and it would be expensive for the state to purchase those access rights. He stated <br />that it is the developer~s obligation to make sure there is not a worse drainage s~tuafion He <br />would Iike to continue to work with the neighborhood to make it as palatable as possible. <br />Approximately two-tkirds of the homes would access from the direction of H~ghway 47, and 47 <br />homes would access from the west. Efforts are being made to balance traffic within the <br />reasonable limitations of the streets. <br /> <br />Comm;~sioner Deemer suggested creating a cul-de-sac to minimize traffic impact on 158th. <br /> <br /> 9 c~-5 e_ <br />Mr. ~ responded that he would prefer to put a cul-de-sac [n, but it would increase tragic on <br />157th. <br /> <br />One resident noted th~ there is an o~k' wilt problem on some of the trees on the site. Since the <br />disease spreads through the roots, he asked what impact there will be with construction, and <br />whether the developer w/J.l guarantee not to spread oak wilt and be liable if it does spread. <br /> <br />Commissioner Deemer stated that trenches can be dug to cut the roots and prevent spread of the <br />disease. However, the City cannot force the developer to trench the boundary to prevent the <br />spread of oak wilt. <br /> <br />Motion by Commissioner HoLland, seconded by CommL~.sioner Deemer to direct the developer to <br />note t_he issues cLiscussed at this meeting and pro,ed to apply for preliminary plat approval <br />through the public hearing process. <br /> <br />Motion can/ed. Voting Yes: Chairperson Bawden, Commisfioners Holland, Deemer, Jenson, <br />LaDue, Terry, and Thom& Voting no: None, Absent: None. <br /> <br />Csse #3 <br /> <br />Review Proposed Ordinance to Establish Regulations for Towers and <br />Antennas <br /> <br />Planning Intern Skoog reported that the C/ty Cound3 approved a 180-day moratorium, effective <br />January 6, 1997, on wirdess per.sonal communication service (PCS) antennas and towers. At the <br />last Planning Commission meeting, Mr. Alexander, from Larkin, Hoffman Da/y and Lindgren law <br />firm, presented several concerns about the proposed oral/nonce to regulate PCS tower sites in the <br />City. The City has received a letter fi-om the law firm that lists requested rev/sions. <br /> <br />Mr. Tom Alexander stated that he is acting on behalf of APT. <br /> <br />Section 9.15.04: Mr. Alexander requested that subparagraph Nos.
