zoned R-1U (Urban). The 1980 Comprehensive Plan makes clear that the City's
urban zoning will be consistent with the boundaries of the MUSA li~.~e. See
Comprehensive Plan, pp. 33-42. The Plan provides that as the MUSA line extends
outward, the zoning allowed within its boundaries will be automatically adjusted.
Ramsey City Ordinance 9.01.03 states that the City's zoning provisiorrs have been
enacted "in accordance with the Comprehensive Plan." Ordinance 9.01.04 further
states that it is the policy of the City that the

· . . enforcement, amendment and administration of (the zoning chapter) be
accomplished with due consideration of the recommendations contained in
the Comprehensive Plan as developed and amended... The Council
recognizes the Comprehensive Plan as the policy adopted to regulate land use
and development in accordance with the policies and purpose herein set
forth.

The Apple Ridge subdivision was automatically rezoned R-1U (Urban) as the
Metropolitan Council moved the boundaries of the MUSA line outward. The
power to make the change on the Official Zoning Map was expressly given to the
zoning administrator in Ramsey Ordinance 9.20.04.

Moreover, state law requires zoning ordinances to comply witlh changes in
their comprehensive plans within nine months. Minn. Stat. § 473.86!5 Subd. 3.
Therefore, once the MUSA line was past the Barthold property, consistent with the
City's Comprehensive Plan, the City was required to amend its zoning ordinances
within nine months to reflect the change. The law will deem to be done that which
must be done.

5
