! <br />! <br /> <br />Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #97-03- <br /> <br />A RESOLUTION ADOPTING FINDING OF FACT # RELATING TO A REQUEST <br />FROM SIDNEY NYHUSMOEN FOR A CONDITIONAL USE PERMIT TO MINE AND <br />EXPORTS SOILS <br /> <br /> WHEREAS, the City of Ramsey received an application from Sidney Nyhusmoen to <br />renew a conditional use permit to mine and export soils from the property legally described as <br />follows: <br /> <br />Lot 1, Block 1, HY-10 RAMSEY 4TH ADDITION, Anoka County, Minnesota. <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />That on March 15, 1994, Sidney Nyhusmoen, hereinafter referred to as "Applicant", <br />properly applied for a conditional use permit to mine and export soils in the I-1 Industrial <br />District. <br /> <br />That the applicant appeared before the Rarnsey Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the City Code on Ar.ql 5, 1994, and that said public <br />hearing was properly advertised and that the minutes of said public hearing were <br />incorporated as a part of the findings by reference. <br /> <br />o <br /> <br />That on April 26, 1994, the City Council granted the Applicant's request for a conditional <br />use permit with an expiration date of May 1, 1997. <br /> <br />That on February 6, 1997, the City of Ramsey received a written request from the <br />Applicant to renew the conditional use p~ermit because the project was not initiated during <br />the 3 year time frame. <br /> <br />o <br /> <br />That the Applicant appeared before the Ramsey Planning Commission for a public <br />heating pursuant to Section 9.03.04 of the City Code on March 4, 1997, and that said <br />public hearing was properly advertised and that the minutes of said public hearing are <br />hereby incorporated as a part of'the findings by reference. <br /> <br />That the subject property is located in the Industrial District, and is approximately 4.4 <br />acres in size. <br /> <br />7. That mining is not a permitted use in the Industrial District. <br /> <br /> <br />
