§ s.so <br /> <br /> a. Any person who commits any of the following acts or violates any <br /> of the provisions of this chapter which prescribe that certain <br /> action is unlawful shall be guilty of a misdemeanor, and upon <br /> conviction thereof shall be fined in an amount not to exceed <br /> $700.00 for each violation and/or 90 days in jail. Each day that <br /> unlawful activity con,hues shall constitute a separate violation: <br /> <br /> 1. Disposes of sewage or installs or renovates an individual <br /> sewage treatment system without first having received a <br /> permit as provided herein. <br /> <br /> 2. Installs or renovates ~ individual sewage treatment system <br /> or discharges sewage in a manner which involves the <br /> knowing and material variation from the terms and <br /> specifications contained in the application or pernfit. <br /> <br /> 3. Violates the terms of an order issued pursuant to the <br /> provisions contained herein. <br /> <br /> 4. Conducts the business of or engages in activities described in <br /> §8.30.05 Subd. 6 herein without first having obtained the <br /> required license. <br /> <br /> 5. Willfully fails to conduct the testing or cleaning obligations <br /> established pursuant hereto or unlawfully refuses a right of <br /> entry to the administrator when requisite notice has been <br /> provided. <br /> <br /> The plurabing inspector may by written order suspend or revoke <br /> any disposal or system permit when he has information <br /> indicating that the permit has been issued in error or on the basis <br /> of incorrect or inadequate information or that work is not being <br /> performed in compliance with this section or the provisions of any <br /> permit issued hereto. <br /> <br />b. Cease and Desist Order. The aara~uistrator may issue an order to <br /> the owner or occupant of any premises utilizing an individual <br /> sewage treatment system to cease and desist the use of any <br /> system which is operating in a manner creating substantial <br /> hazard to the public, health, safety, or welfare or wkich has not <br /> been repaired in accordance with the provisions of an order <br /> issued pursuant to §8.30.08 herein. A noticed public hearing <br /> shall be held within 14 days following the issuance of such an <br /> order to deterra~ne whether the order should be continued in force <br /> and effect. <br /> <br /> The plumbing inspector may cause to be assessed against the <br /> property on which an individual sewage treatment system is <br /> located the cost of proper closure, restoration and cleanup of <br /> pollution occurring as a result of a system failure.
