You may.recall that we wa~e giver~ ample opportunity to
withdraw from the contract. As the events unfolded, you oen imagine our frustration.
The planning unraveled everyweek until winter approached. Fortunately for everyone,
E.H. Rennet was there on stand-by. We chose Rennet b$cause of their promise to
move quickly. The damages and losses we faced vwe?e .secondary toour concern of
completion of the well. Fodeiture of a contract and performance bond is far more
damaging to a small company. The contract and bond re,sins intact, but now we must
pay the price two-fold.

i E.H. Renner's 2nd place Did came in at $t4,000.00 higher than AWS. A sizable
savings for the city. We paid Rennet his bid price as part: of the subcontract. AWS
realized a loss of much more than $14,000,00. Further losses will be expected in the

i form of liquidated damages. A total of 38 days at $2'00.'00~day equals $7,600.'00. You
must certainly recognize the significance of these numbers AW$ kindly asks for your
considerations. Please convey this letter to the City of R .amsey and advise us of their
i opinion on these matters. We don't ask for complete remeval.of.all the damages, but
ask if the, penalty fits the true. damages the de~ay czeatad.

i WATER SERVICES, LLC
Regards,

Steve Alberg
I Chief of Operations
SA/r. mlp

NO: 631
